Start with the nature of the disagreement
Identify whether the issue concerns a commercial contract, employment, property, rent, a consumer transaction, or another subject. Record the parties, locations, dates, and any existing proceeding. A specialised authority or preliminary process may be relevant. Tell counsel about all related claims so that a filing is not planned in isolation from another case or an agreed dispute mechanism.
Read the jurisdiction clause precisely
Distinguish a reference to UAE or Dubai law from a clause selecting a particular court. DIFC Courts’ official guidance explains that qualifying civil and commercial disputes can come within its jurisdiction through a written opt-in agreement as well as its other jurisdictional bases. That does not mean every Dubai contract automatically opts in. Have the actual wording and its legal effect assessed.

Separate the court from the law it applies
The governing law and the forum are related but different questions. DIFC Courts explains that choosing its jurisdiction does not, by itself, change the law chosen for the contract. Arbitration clauses raise another set of questions, including authority and enforceability. Avoid copying a clause from an unrelated agreement without understanding the transaction, parties, and practical consequences of the choice.
Prepare for the forum’s document requirements
Dubai Courts’ civil-service guidance identifies Arabic legal-translation and supporting-document requirements. DIFC Courts operates an English-language common-law forum. Neither point means that every document in every proceeding follows the same route. Ask about the particular filing’s language, attestation, service, fee, and evidence requirements before translating a large bundle or relying on a form prepared for a different system.
Consider the full path to an effective outcome
Discuss interim steps, deadlines, the cost of the procedure, and where relevant assets are located. Recognition and enforcement may require further work after a judgment or award. Keep settlement discussions distinct from court compliance, and do not assume they pause time limits. A sensible plan explains both the immediate filing and the later steps that may be needed to obtain practical relief.
